After months of rushing his prosecution of former President Donald Trump, special counsel Jack Smith suddenly seems in no hurry to near the end of his second embattled case.

Conservative legal scholar Jonathan Turley wrote on Friday that he believes the Biden Justice Department prosecutor Smith can read the writing on the wall as it pertains to his ongoing J6 and dead classified documents cases. The “former version of Jack Smith,” he argues, would have been delighted to see D.C. federal judge Tanya Chutkan move quickly to set an August 16th conference to lay out the schedule and issues going forward; now, in the wake of a landmark Supreme Court ruling granting presidents absolute immunity from prosecution of official acts, Smith said his team is not ready to present arguments for what crimes President Trump may have committed related to the January 6th, 2021 riots at the Capitol.

Smith told the court, “The Government continues to assess the new precedent set forth last month in the Supreme Court’s decision in Trump v. United States. Although those consultations are well underway, the Government has not finalized its position on the most appropriate schedule for the parties to brief issues related to the decision,” Turley wrote on his law blog Friday. Instead, Smith is asking for a three-week reprieve as he prepares on how best to argue that Trump’s words or actions that day contributed to violence and interference with official congressional proceedings. Turley writes:

The question is whether Smith is considering a drastic move in light of the calendar and the ruling. There is, of course, always the possibility that he either throws in the towel or opts for a post-election trial. That would certainly go against the grain of Smith, who has always pushed both the law and the calendar to the breaking point. However, as some of us have been arguing for months, he may no longer view a trial as a plausible objective.

There is also the possibility that Smith will do something that some of us have discussed over the last year: pare down his case. Smith has always been undone by his appetite. As shown in his 8-0 reversal in his conviction of former Virginia Governor Bob McDonnell, Smith has rarely shown moderation as a prosecutor.

In the latter case, Smith successfully prosecuted former Gov. McDonnell on bribery charges only to see his conviction overturned by the Supreme Court, another decision that grants elected officials wide latitude in accepting gifts without a direct quid pro quo. As he did then, Turley argues, Smith “loaded up” his felony charges against Trump with a plethora of wrongdoings that he may now pare back as he realizes he may be on the verge of seeing his second case dismissed. In July, Florida U.S. District Judge Aileen Cannon tossed his case against Trump alleging that he improperly handled classified documents found in his possession after an FBI raid of Mar-a-Lago.

Fetterman said his home state voters will size up Trump against Vice President Kamala Harris and find out the choice is obvious. “I think if you match up Trump with Harris, and I think that’s what this is really about, and I do believe he’s going to win Pennsylvania. And I do believe it’s going to be close, but whether it’s Biden, whether it was Clinton, or whether it was with Vice President Harris I think it’s going to be very close.”

The discussion followed an hourlong press conference staged by former President Donald Trump at his Mar-a-Lago residence where he lambasted Democrats for pushing President Joe Biden out of the race and knocked Harris as not “smart enough” to debate him. The vice president has agreed to honor Biden’s commitment to a September 10th debate but has rebuffed Trump’s calls for additional showdowns, saying she would make a decision after their first.

“When is Harris going to start taking questions? Taking two questions on the way from the tarmac is not taking questions,” one panelist said in reaction to a 70-second stop that Harris had with reporters on her way to a campaign event. The appearance was essentially the only one she has held since launching her presidential campaign, sticking instead to tightly controlled speeches backed by teleprompters. Another agreed that Trump’s pressure has helped to “trap her” into eventually talking to the media.

“Look, she’s going to take questions. We’re going to make sure of that. But, you know, there’s been a bit of a honeymoon period. I think she’s giving Tim Walz a moment, but he did make that contrast, I think, really clear. The rest of it was such a waste of time,” said the female guest, referring to Trump’s additional statements about the 2020 election and his continued prosecutions by the Justice Department. Sellers, a former Democratic state lawmaker from South Carolina, did his best to defuse legitimate questions about whether the Harris campaign is better to fire off rapid response social media posts in response to Trump’s appearance than to have their candidate take to a podium and share her thoughts. “What I’m just saying to you is that this campaign is not just one that’s online.”

“You lose credibility” when you defend her avoidance of the press, a female panelist shot back, “Because if it was someone else you would be demanding that they sit down for questions! And you know what? It will make her a better candidate if she does it.”

Liberal Fox News host Jessica Tarlov got smacked down by her colleagues on “The Five” after suggesting that Republicans are mischaracterizing Minnesota Gov. Tim Walz’s resignation from the Army shortly before his battalion deployed for Iraq so he could run for Congress.

On Wednesday night Tarlov spoke in opposition to a press conference from Republican vice presidential candidate Sen. J.D. Vance (R-OH) after he criticized Walz’s military record at a campaign event in Michigan. At the event, the Ohio Republican claimed Walz abandoned his unit. “What really bothers me about Tim Walz, as a Marine who served his country in uniform, when the United States Marine Corps, when the United States of America asked me to go to Iraq to serve my country, I did it. I did it when they asked me to do it and I did it honorably, and I’m very proud of that service,” he stated during an appearance in Shelby Township. “When Tim Walz was asked by his country to go to Iraq, you know what he did? He dropped out of the Army and allowed his unit to go without him, a fact that he’s been criticized for aggressively by a lot of the people that he served with.” Retired military service members who knew Walz at the time made similar claims in a letter that resurfaced earlier this week.

That didn’t sit well with Tarlov, who asserted that Walz served “honorably” and pivoted to attacking former President Donald Trump for claiming that bone spurs in his feet prevented him from entering the draft during the Vietnam War. “So obviously, this was going to come up because the Trump campaign manager was the one behind the John Kerry Swift Boat attack, which was obviously very persuasive to people,” said Tarlov, according to Raw Story. “He served for 24 years, honorably, then he stopped to run for Congress on a platform of ending the war, and I don’t think that anyone, especially with Donald Trump at the top of a ticket, he dodged the draft four or five times, bone spurs, Captain Bone Spurs.”

Co-host Greg Gutfeld shot back, “Bone spurs are a very serious issue, Jessica.” She continued her rant, getting out, “[Trump] said that people who had gotten captured, ‘suckers and losers,’” before others began to talk over her. “He denied he slept with Stormy Daniels but that obviously hasn’t worked out for him. I don’t think you should ever say anyone who served didn’t do a good job in this. If J.D. Vance wants to get into that tit-for-tat, he was in the public affairs department. Liberal Fox News host Jessica Tarlov got smacked down by her colleagues on “The Five” after suggesting that Republicans are mischaracterizing Minnesota Gov. Tim Walz’s resignation from the Army shortly before his battalion deployed for Iraq so he could run for Congress.

On Wednesday night Tarlov spoke in opposition to a press conference from Republican vice presidential candidate Sen. J.D. Vance (R-OH) after he criticized Walz’s military record at a campaign event in Michigan. At the event, the Ohio Republican claimed Walz abandoned his unit. “What really bothers me about Tim Walz, as a Marine who served his country in uniform, when the United States Marine Corps, when the United States of America asked me to go to Iraq to serve my country, I did it. I did it when they asked me to do it and I did it honorably, and I’m very proud of that service,” he stated during an appearance in Shelby Township. “When Tim Walz was asked by his country to go to Iraq, you know what he did? He dropped out of the Army and allowed his unit to go without him, a fact that he’s been criticized for aggressively by a lot of the people that he served with.” Retired military service members who knew Walz at the time made similar claims in a letter that resurfaced earlier this week.

Jon Tester (D-MT), the most vulnerable incumbent of the 2024 cycle, now sits two points behind his Republican challenger Tim Sheehy, a former Navy SEAL, Bronze Star recipient, and one of the Republican Party’s strongest recruits. Sheehy leads Sen. Tester 48% to 46% in a head-to-head matchup with 5% of voters remaining undecided.

Tester, who is seeking his fourth six-year term, has served in the Senate since 2006 after eight years in the state Senate and an earlier career as a farmer. He narrowly escaped losses in both 2012 and 2018, but it appears the Republican Party of President Trump has finally caught up to him. Two national polls released Tuesday show the former president clawing to the front once more, a change from polls last week indicating the race was essentially deadlocked. Surveys from CNBC and Rasmussen give Trump leads of 2% and 5%, respectively. The All-America Economic Survey by CNBC showed Trump ahead of Harris 48% to 46%, and voters are giving him a massive endorsement on handling of the economy, preferring him by a margin of more than 2-to-1. Another good sign for Trump: the results are virtually unchanged from CNBC’s July poll when he led President Joe Biden 45% to 43%, suggesting Vice President Harris’s new rivalry hasn’t dented his standing among swing voters.

The Rasmussen survey also shows Trump maintaining a level amount of support in a head-to-head matchup. But in a scenario where independent Robert F. Kennedy, Jr. is on the ballot, the former president’s support increased by 3% since July to 49% while Harris and RFK lost 1% and 2%, respectively. With a margin of error of +/- 2%, President Trump is well ahead in the large survey.

Still, Harris may glean bits of good news as well: a dramatic shift in the CNBC poll showed that 81% of Democrats are now satisfied with her nomination compared to just 33% at the nadir of Biden’s campaign. Support among young voters has swung her way as well; where Trump enjoyed a 2% lead among voters under 30 back in July, Harris now leads the group by 10%. However, that was offset by a swing of 12% more support to Trump among voters ages 35-49, a demographic that now supports Trump by 9%.

“It is less now a referendum on Trump than it is a head-to-head competition between the two candidates,” said Micah Roberts, partner at the Republican firm Public Opinion Strategies who helped conduct the CNBC survey. Jay Campbell, partner at Hart Research who served as the Democratic pollster, added that Harris is making up for the sins of her boss in the eyes of voters. “She’s still carrying a lot of water for the administration,” Campbell said. “She has to answer for that and define herself independently…That’s a lot of baggage to carry when you’ve got a compressed time frame against a mature campaign on Trump’s side.”

The economy remains front and center for voters and ranks at or near the top of the list alongside immigration, both issues where President Trump holds commanding leads. A large majority of Americans believe their pocketbooks and bank accounts will be better off under a second Trump administration, and even worse for Harris is data showing just 48% of Democrats believe she would be a better economic steward while 42% believe it makes no difference.

Before Harris’s entrance into the race, only a minuscule number of voters remained undecided between Trump and Biden; now the number of undecided independent voters has risen to 20%. The campaign that is most successful in courting this sliver of the electorate may ultimately come out the winner in November.
