Biden’s pathetic Supreme Court putsch

Were President Joe Biden not a lame duck, his attack on the Supreme Court would be more worrying. It’ll go nowhere but it is nevertheless another stain on his thoroughly soiled career, undertaken in a last desperate partisan gasp as the Democratic Party shoves him ruthlessly aside.

House Speaker Mike Johnson (R-LA) called the president’s plan “dead on arrival,” to which Biden responded with now-characteristic clumsiness, “I think that’s what he is.” This was especially awkward given that former President Donald Trump had been shot by a would-be assassin two weeks earlier.

The substance of Biden’s proposals is just as bad as his rhetoric. He falsely claimed that a recent Supreme Court decision “means there are virtually no limits on what a president can do.” Anyone who can read knows the court did no such thing. The majority decision backed Youngstown Sheet & Tube Co. v. Sawyer, in which the Supreme Court blocked President Harry Truman’s seizure of the nation’s steel mills during the Korean War. That decision held that presidents may not act outside their legal authority and that they could be blocked by courts if they tried. That case is still good law, no matter what Biden says.

Second, Biden called for 18-year term limits for all Supreme Court justices. It is unclear if he wants a constitutional amendment for this item, but he’ll need one. The Constitution is clear that Supreme Court justices are to have life tenure, and legislation that tries to skirt this by labeling some justices “Senior Justice” won’t pass constitutional muster. Federalist No. 78 is clear about the “essential” nature of the “permanent tenure of judicial offices” in maintaining a functional balance in the separation of powers. No “senior status” gimmick is compatible with the Constitution’s original design.

Finally, Biden proposes a “binding code of conduct” for the Supreme Court, calling the current code weak since it is “self-enforced.” But here again, the president’s wishes smash up against the Constitution. The judicial branch is free to design and enforce its own ethics guidelines and indeed has done so. Parties can and do file ethics complaints against federal judges which are then heard by other federal judges and could, in theory, make it all the way to the Supreme Court. But the Supreme Court is already the highest court. Congress does not have the constitutional authority to give lower courts power to render judgments on the ethics or recusal decisions of Supreme Court justices.

It would be bad policy if they did. More than 1,000 complaints have been filed against U.S. District Judge Aileen Cannon for her handling of Trump’s classified documents case. These are mostly, perhaps entirely, scurrilous political attacks. Opening Supreme Court justices to similar campaigns would expand to an industrial scale the Left’s campaign of harassment against justices who decide cases on their constitutional merits rather than in line with a “progressive” agenda. Biden’s proposal would do nothing to improve the transparency of justice’s ethical and recusal decisions.

When it was inventing rights to abortion, for example, Democrats loved the Supreme Court’s unmoored ability and willingness to make new law. But now that conservatives are returning the court to its proper limits, Democrats want to weaken it and undermine the Constitution.

Biden is scratching around for relevance now that he is being pushed out in favor of Vice President Kamala Harris. He has chosen to latch on to a completely partisan issue that has no hope of passing with just three months before Election Day. Kari Lake wins Arizona GOP election in her bid to succeed Sinema in the Senate 

Kari Lake won a closer-than-expected GOP primary to replace outgoing Sen. Kyrsten Sinema (I-AZ), setting the stage for a marquee Senate race against Rep. Ruben Gallego (D-AZ) that could determine the balance of power in the upper chamber. 

Lake, who unsuccessfully ran for governor in 2022, received 53% of the vote with two-thirds of the ballots counted when the primary was called at 11:44 p.m. Eastern. Meanwhile, her primary opponent, Pinal County Sheriff Mark Lamb, received 41% of the vote. Lake’s victory was much narrower than expected, which could spell larger problems for Republicans in the Grand Canyon State, where voters have repeatedly rejected former President Donald Trump and the candidates he endorses in general elections.

The former news anchor will face Gallego, who is running unopposed, to replace Sinema who was elected in 2018 but left the Democratic Party last year to become an independent. The Arizona senator considered running as an independent but ultimately opted against it in March.

After receiving the endorsement of Trump and out-fundraising her competitors in the Republican race, Lake has focused her messaging on Gallego and the Biden administration. According to the last campaign finance report in early July, Lake had $2.1 million in cash on hand compared to Lamb’s $263,000.

Gallego has nearly $8.2 million on hand, according to campaign finance records. The nonpartisan Cook Political Report rates this race as lean Democratic. 

In 2022, Lake ran for governor in the state as a hard-charging conservative outsider who was quick to turn on the GOP establishment — and at the time, her campaign was one national Republicans kept at arm’s length, worried about her electability in the battleground state. This cycle, the Senate Republicans’ campaign arm endorsed Lake’s candidacy in February. 

Since launching her campaign, she made some efforts to shift her most unpopular views, but they haven’t been consistent. She criticized a near-total abortion ban in Arizona but previously had called it a great law. Even after Sen. Steve Daines (R-MT), the chairman of the Senate Republican Campaign arm, advised her to stay clear of election fraud claims; she hasn’t listened. 

Lake filed another appeal earlier this month asking the Arizona Supreme Court to declare her governor two years after she lost that election, despite her current run for the state’s open Senate seat. Her attorneys filed a petition arguing the Superior Court and Court of Appeals should have reinstated her case over new evidence. Gallego is leading by 3.4 points in an average of polling.

Since Sinema’s victory in 2018, Arizona has transformed from a solid red state to one of the country’s most competitive battlegrounds.

Hamas chief Ismail Haniyeh killed in Iran thumbnail

Hamas chief Ismail Haniyeh killed in Iran

The leader of Hamas, Ismail Haniyeh, was killed along with one of his bodyguards in Tehran, Iran.

Haniyeh, 62, head of Hamas’s Political Bureau, resided in Qatar throughout the Israel-Hamas war and was visiting Tehran for the inauguration of Iranian President Masoud Pezeshkian. His death was announced by the Iranian Islamic Revolutionary Guards Corps and confirmed by Hamas in the early hours of Wednesday, local time. Hamas immediately blamed Israel for his death.

“The Islamic Resistance Movement Hamas mourns the sons of our great Palestinian people, the Arab and Islamic nation, and all the free people of the world: the brother leader, martyr, Mujahid Ismail Haniyeh, head of the movement, who was killed as a result of a Zionist raid,” Hamas announced on its Telegram channel. “He left his residence in Tehran, after participating in the inauguration ceremony of the new Iranian president. We belong to God and to Him we shall return, and indeed it is a jihad, victory or martyrdom of the Islamic Resistance Movement.”

Haniyeh is believed to be at least the second leader of one of the Middle East terrorist groups that Iran supports and has ties to, CNN reported. On Tuesday, in Lebanon, Israel confirmed it killed Fu’ad Shukr, one of “Hezbollah’s most senior military commanders.” Among other terrorist acts, Shukr was also known as the mastermind behind the 1983 bombing in Beirut, Lebanon, that killed 241 U.S. troops.

“Today, July 30, 2024, in a targeted, intelligence-based elimination, Israeli Air Force fighter jets eliminated the Hezbollah terrorist organization’s most senior military commander and the head of its Strategic Unit, Fuad Shukr,” Israel’s military said in a statement.

In April, three of Haniyeh’s sons and three of his grandchildren were killed in an Israeli airstrike. He claimed that 60 of his family members had been killed in the war since Oct. 7.

Hamas sympathizers, Palestinian factions, and other pro-Palestinian supporters in the West Bank sought a response to Haniyeh’s death. Organizers in the region encouraged people to engage in protests, marches, and a strike on Wednesday as a response, according to multiple reports.

“The national and Islamic factions in Palestine announce a comprehensive strike and anger marches to (protest) the assassination of the great national leader Ismail Haniyeh, which came in the framework of Zionist state terrorism and its war of extermination,” read a statement from Palestinian factions.

Iranian President Masoud Pezeshkian released a statement in response to the strike, the Times of Israel reported. He announced that his country would “defend its territorial integrity, dignity, honor, and pride, and will make the terrorist occupiers regret their cowardly act.”

The leader of Hamas, Ismail Haniyeh, was killed along with one of his bodyguards in Tehran, Iran.

Haniyeh, 62, head of Hamas’s Political Bureau, resided in Qatar throughout the Israel-Hamas war and was visiting Tehran for the inauguration of Iranian President Masoud Pezeshkian. His death was announced by the Iranian Islamic Revolutionary Guards Corps and confirmed by Hamas in the early hours of Wednesday, local time. Hamas immediately blamed Israel for his death.

“The Islamic Resistance Movement Hamas mourns the sons of our great Palestinian people, the Arab and Islamic nation, and all the free people of the world: the brother leader, martyr, Mujahid Ismail Haniyeh, head of the movement, who was killed as a result of a Zionist raid,” Hamas announced on its Telegram channel. “He left his residence in Tehran, after participating in the inauguration ceremony of the new Iranian president. We belong to God and to Him we shall return, and indeed it is a jihad, victory or martyrdom of the Islamic Resistance Movement.”

Haniyeh is believed to be at least the second leader of one of the Middle East terrorist groups that Iran supports and has ties to, CNN reported. On Tuesday, in Lebanon, Israel confirmed it killed Fu’ad Shukr, one of “Hezbollah’s most senior military commanders.” Among other terrorist acts, Shukr was also known as the mastermind behind the 1983 bombing in Beirut, Lebanon, that killed 241 U.S. troops.

“Today, July 30, 2024, in a targeted, intelligence-based elimination, Israeli Air Force fighter jets eliminated the Hezbollah terrorist organization’s most senior military commander and the head of its Strategic Unit, Fuad Shukr,” Israel’s military said in a statement.

In April, three of Haniyeh’s sons and three of his grandchildren were killed in an Israeli airstrike. He claimed that 60 of his family members had been killed in the war since Oct. 7.

Hamas sympathizers, Palestinian factions, and other pro-Palestinian supporters in the West Bank sought a response to Haniyeh’s death. Organizers in the region encouraged people to engage in protests, marches, and a strike on Wednesday as a response, according to multiple reports.

“The national and Islamic factions in Palestine announce a comprehensive strike and anger marches to (protest) the assassination of the great national leader Ismail Haniyeh, which came in the framework of Zionist state terrorism and its war of extermination,” read a statement from Palestinian factions.

Iranian President Masoud Pezeshkian released a statement in response to the strike, the Times of Israel reported. He announced that his country would “defend its territorial integrity, dignity, honor, and pride, and will make the terrorist occupiers regret their cowardly act.”

Since launching her campaign last week, speculation has swirled as to who Harris will pick as her vice president, with many strategists believing it will be a centrist Democratic governor. She is set to unveil her pick shortly before a joint Philadelphia rally next week, according to Politico.

After the Philadelphia kickoff rally, the two will hold rallies in Wisconsin, Detroit, Raleigh, North Carolina; Savannah, Georgia; Phoenix, and Las Vegas.

“Next week, Vice President Harris and her future running mate will crisscross the country together to campaign to the voters who will decide this election. As a strong reminder, and as she said today, Vice President Harris has made no decision on a running mate,” the Harris campaign said in a statement.

The choice of Philadelphia as the launch of the Democratic duo may hint as to who she is leaning toward, however, as it will be in Gov. Josh Shapiro’s (D-PA) own state.

Shapiro has been campaigning for Harris at several stops, taking shots at former President Donald Trump and his running mate, Sen. J.D. Vance (R-OH).
