An old social media post is now haunting New York Attorney General Letitia James after she was indicted Thursday by a federal grand jury in Virginia on charges of bank fraud and false statements.

In February 2024, James tweeted: “When powerful people cheat to get better loans, it comes at the expense of hardworking people. Everyday Americans cannot lie to a bank to get a mortgage … There simply cannot be different rules for different people.” She was explicitly attacking President Donald Trump at the time.

The criminal case centers on a 2020 home purchase in Norfolk, Virginia. Prosecutors claim James misrepresented the property as a second residence to secure favorable mortgage terms, then allegedly rented it out — violating the terms she declared.

Lindsey Halligan, U.S. Attorney for the Eastern District of Virginia, warned that each count carries up to 30 years in prison, along with fines and forfeiture.

Critics were quick to point out the irony: James charged Trump with financial deception using the very language she’s now accused of violating. Rep. Elise Stefanik (R-NY) accused James of hypocrisy, noting that she once prosecuted Trump for “lying, cheating, and staggering fraud,” then used a nearly identical message against him.

“Her hypocrisy is profound as she campaigned on the mantra that ‘no one is above the law,’ yet she now faces allegations of committing the very type of financial misrepresentation she baselessly pursued against President Trump,” Stefanik said.

James is no stranger to legal battles with Trump. She previously won a civil fraud judgment against his business empire — often using rhetoric about financial honesty and accountability.
