A newly released FBI document has ignited a political firestorm on Capitol Hill, with top Republicans accusing the Biden administration of weaponizing federal law enforcement against its political opponents.

According to Senator Chuck Grassley (R-IA), the document shows that the FBI secretly conducted toll-record analysis on eight Republican senators as part of its controversial “Arctic Frost” investigation — a probe that later became Special Counsel Jack Smith’s “elector” case against then former President Donald Trump.

Grassley published the document Monday morning, calling it proof that the FBI “spied” on sitting senators without proper justification. The one-page memo, dated September 27, 2023, is marked “UNCLASSIFIED//FOUO” and titled “CAST Assistance.” It reveals that the Washington Field Office authorized preliminary toll analysis — a review of call and text records — on limited phone numbers tied to several high-profile lawmakers.

The memo lists Senators Lindsey Graham (R-SC), Bill Hagerty (R-TN), Josh Hawley (R-MO), Dan Sullivan (R-AK), Tommy Tuberville (R-AL), Ron Johnson (R-WI), Cynthia Lummis (R-WY), and Marsha Blackburn (R-TN) among the individuals whose records were scrutinized.

“This document shows the Biden FBI spied on 8 of my Republican Senate colleagues during its Arctic Frost investigation,” Grassley wrote on X. “Arctic Frost later became Jack Smith’s elector case against Trump.”

In a press event with Grassley, Senator Ron Johnson (R-WI) described the program as “a fishing expedition” that lacked any legitimate predicate.

“We were given a briefing to try and convince us that the Hunter Biden laptop was no big deal,” Johnson said, recalling previous efforts by the FBI to downplay evidence of corruption. “This is major corruption that’s being revealed inside the Obama and Biden Department of Justice and the FBI.”

The Arctic Frost probe, first reported last year, was originally described by Justice Department sources as an “election law” investigation focusing on so-called “fake electors” in the 2020 presidential race. According to Grassley, the investigation quietly expanded far beyond Trump campaign officials to include Republican members of Congress and conservative organizations.

“We wouldn’t know about the list of 100 Republican entities that were targeted if not for whistleblowers,” Johnson added.

Senator Bill Hagerty (R-TN) called the revelation “extraordinary,” echoing Johnson’s criticism of the FBI’s conduct. “None of us were targets of this investigation,” Hagerty said. “There’s no predicate. There’s no reason for this other than a fishing expedition, which should outrage and shock every American.”

The memo is dated just weeks after Special Counsel Jack Smith announced charges against Trump in August 2023 and more than a year after the Mar-a-Lago raid. “This is almost two months later, and they’re casting this net against members of the Senate and the House,” Johnson said. “This is outrageous,” he added.

Grassley has vowed to pursue answers through his role on the Senate Judiciary Committee, citing the need for transparency. The memo itself contains no explanation of why the senators’ toll records were examined, noting only that a “Special Agent” conducted preliminary toll analysis of limited numbers associated with the following U.S. Senators.

Still, for Republicans who have long warned of a politicized Justice Department, the disclosure is being treated as confirmation of their worst suspicions. Grassley closed his statement by crediting whistleblowers for bringing the memo to light.
